[약관동의] 

귀하(이하, 자료 수집을 동의한 자)는 스웨덴 회사인 Nordic Nest AB(이하 "Nordic Nest", 사업자 번호 556628-1597)에 귀하의 인스타그램 컨텐츠(사진/비디오/캡션/텍스트 등 일체) 및/또는 귀하가 허가한 자료에 대한 “편집, 재배포 가능, 그리고 기간의 정함이 없는 자료 사용 권한”(이하 사용 권한)을 부여함에 대해 동의합니다. 이는 “Nordic Nest” 가 운영하는 모든 글로벌 웹 사이트 및 기타 마케팅 채널 일체에 “사용 권한”을 부여하는 것을 확인합니다.

귀하는 귀하가 제출한 자료에 포함된 모든 내용에 대한 관리 권한과, 사진/동영상에 등장하는 모든 사람의 동의를 수락하였다는 사실을 대표하고 보증합니다. 또한 귀하는 귀하가 개인(즉, 법인이 아님)이거나, 18세 이상이거나, 그렇지 않다면 법정 보호자의 동의를 수락하였음을 보증합니다. 귀하가 제출한 자료에 포함된 내용물들은 제3자의 권리 침해 또는 어떠한 법률 위반도 포함 되어있지 않는다는 것을 보증합니다.

귀하가 제출한 자료에 대해 책임은 제출자 본인에게 있습니다. 귀하는 Nordic Nest, Nordic Nest 계열사, 그리고 이들을 대신하여 권리를 행사하는 대리인들이 발생시키는 이익과, 제출된 자료(이하 인스타그램 컨텐츠)들의 성과는 관련이 없음을 확인합니다. 이에 귀하가 제출한 자료의 사용 도중 발생하는 지적 재산권에 대해서, Nordic Nest(이하 “사용자”)는 귀하에게 금전 등의 대가를 지불해야 하는 모든 의무에서 “사용자”는 해제된다는 사실을 확인하였습니다.

Nordic Nest는 인스타그램 콘텐츠를 사용할 권리는 있지만, 의무는 없습니다.

스웨덴 법은 본 계약과 계약에서 파생될 수 있는 모든 당사자 간의 법적 관계에 적용됩니다. 이 합의로 인해 발생한 분쟁은 스웨덴 칼마르 지방법원을 제1심으로 하는 일반법원에서 해결합니다.

You give Nordic Nest AB, a Swedish company with organizational number 556628-1597, (hereinafter “Nordic Nest”), a royalty-free, global, irrevocable, non-exclusive and perpetual license to edit and use your Instagram content (photograph/video/caption/text etc.) and/or any other material submitted by you to any of Nordic Nest's websites for all marketing and advertising purposes. This includes the right to reproduce, distribute, alter and edit your photos for all of Nordic Nest's websites and other marketing channels used by Nordic Nest.

You represent and warrant that you own or control the rights to the material you have submitted and that you have permission from any person(s) appearing in the photos/videos. Furthermore, you certify that you are an individual (i.e., not a corporation), you are at least 18 years of age or have parental consent, and that the material submitted by you does not violate any rights of a third party or any law.

You are solely responsible for your material. You agree to hold Nordic Nest, its affiliates or any other person acting on Nordic Nest's behalf, harmless from and against any claims and expenses, regardless of the nature, arising from any use of your Instagram content or any other material submitted by you as described above. You hereby release Nordic Nest from all obligations to pay you for the use of your images and for the intellectual property rights of those associated with the above-described use.

Nordic Nest has a right, but not an obligation, to use your Instagram content.

Swedish law shall apply to this agreement and to all legal relationships between the parties that may be derived from the agreement. Disputes arising from this agreement shall be settled in general court with the Kalmar District Court as the first instance.
